Need a Power of Attorney Notarized in NYC?

A Power of Attorney can be an important document, and when it's time to have one signed, families often have questions about the notarization process.

You may be coordinating the appointment at home, at an attorney's office, in a hospital or nursing facility, or somewhere else that is convenient for the signer.

A little preparation can help the appointment go much more smoothly.

Here are several things to check before scheduling a mobile notary for a Power of Attorney.

1. Have the Complete Document Ready

Before the appointment, make sure you have the complete Power of Attorney document and any instructions provided by the attorney or organization that prepared it.

A notary's role is not to prepare the document, explain its legal effect, or advise you about which provisions you should select.

If you have questions about the contents of the Power of Attorney, contact the attorney or organization that prepared the document before the appointment.

2. Don't Sign Before the Appointment If the Signature Must Be Witnessed

Before signing anything in advance, check the document's instructions.

If a signature needs to be made in the presence of the notary or other required individuals, signing prematurely could create unnecessary complications.

When in doubt, wait until the appointment.

3. Make Sure the Signer Has Acceptable Identification

Ask the signer to have acceptable identification available for the appointment.

This becomes particularly important when arranging a visit to a hospital, rehabilitation center, nursing facility, or assisted-living community, where the signer may not have their usual identification readily available.

If there may be an identification issue, mention it when requesting the appointment rather than waiting until the notary arrives.

Review the document and any instructions from the attorney or receiving organization to determine whether witnesses are required and who may serve in that role.

Do not assume a mobile notary will automatically provide witnesses or that employees at a hospital or nursing facility will be available to serve as witnesses.

5. The Notary Must Interact With the Signer

The notary will need to communicate with the person whose signature is being notarized and complete the required notarial procedure.

Family members can certainly help coordinate the appointment, but they cannot complete the notarization on another person's behalf simply because they scheduled the service.

If there are circumstances that could affect the appointment, discuss them with the notary beforehand.

6. Send the Appointment Details in Advance

When requesting a mobile appointment, provide basic information such as:

  • The type of document

  • Number of signers

  • Approximate number of signatures requiring notarization

  • Appointment location

  • Preferred date and time

  • Whether witnesses are expected

  • Any facility check-in instructions

There's no need to send unnecessary sensitive personal information just to request an appointment.

7. Don't Wait Until the Document Is Urgent

Power of Attorney appointments are sometimes requested during stressful or time-sensitive situations.

Whenever possible, schedule early enough to address questions involving identification, witnesses, facility access, or document instructions before the appointment.
